1. Acceptance of Terms

By accessing or using ExamProx ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ExamProx is an AI-powered certification exam simulator platform that converts uploaded exam materials into interactive practice exams using the .examx file format. The Service is provided as a Software as a Service (SaaS) product.

3. Account Registration

To use the Service, you must create an account by providing a valid name, email address, and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Free Trial

New users receive a 24-hour free trial with limited access. No credit card is required for the trial. Trial limitations include a maximum of 2 file uploads, 2 .examx downloads, and exam designer limited to 10 questions. The trial expires exactly 24 hours after registration.

5. Pro Subscription

The Pro plan is available at $3 per month, billed monthly via Stripe. The subscription provides unlimited access to all features. You may cancel your subscription at any time with no penalty. Upon cancellation, you will retain access until the end of your current billing period.

6. Payment and Billing

All payments are processed securely through Stripe. If a renewal payment fails, your account will enter a 3-day grace period. If payment is not resolved within the grace period, your account features will be locked until payment is successfully processed. Your data is never deleted, even if your subscription expires.

7. Acceptable Use

You agree not to:

• Upload copyrighted material you do not have the right to use
• Use the Service to distribute actual exam questions from live certification exams
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use the Service for any unlawful purpose
• Share your account credentials with others
• Attempt to circumvent subscription or usage limitations

8. User Content

You retain ownership of all content you upload to the Service. By uploading content, you grant ExamProx a limited license to process and convert your files for the purpose of providing the Service. ExamProx does not claim ownership of your uploaded files or generated .examx files.

The ExamProx name, logo, and the .examx file format specification are the intellectual property of ExamProx. The Service and its original content, features, and functionality are owned by ExamProx and are protected by international copyright, trademark, and other intellectual property laws.

11. Limitation of Liability

ExamProx is provided "as is" without warranty of any kind. ExamProx does not guarantee that uploaded files will be successfully converted, that extracted questions will be accurate, or that using the Service will result in passing a certification exam. In no event shall ExamProx be liable for any indirect, incidental, special, consequential, or punitive damages.

12. Data Retention

Your data, including uploaded files, generated exams, and account information, is retained even if your subscription expires. You may request deletion of your account and all associated data by contacting support.

13. Termination

ExamProx reserves the right to suspend or terminate your account if you violate these Terms of Service. You may terminate your account at any time by contacting support.

14. Changes to Terms

ExamProx reserves the right to modify these Terms of Service at any time. We will notify users of significant changes via email. Your continued use of the Service after changes constitutes acceptance of the modified terms.
